1. Introduction
Welcome to SpinVibe. These Terms and Conditions ("Terms") constitute a legally binding agreement between you and Savage 7 Tech ("we," "us," or "our") governing your access to and use of the SpinVibe mobile application, website, and related services (collectively, the "Service"). By registering, accessing, or using our Service, you agree to be bound by these Terms. If you do not agree to these Terms, do not use our Service.
2. Definitions
- "Content" means any text, graphics, images, music, software, audio, video, information or other materials.
- "User" means a person who has registered for an account on the Service.
- "User Content" means any Content that Users post, upload, share, store, or otherwise provide to or through the Service.
- "Subscription" means a paid membership that grants access to premium features.
3. Eligibility
3.1 Age Requirement
You must be at least 18 years old (or the age of majority in your jurisdiction, if higher) to create an account and use the Service. By creating an account and using the Service, you represent and warrant that:
- You are at least 18 years old (or the age of majority in your jurisdiction, if higher).
- You can form a binding contract with Savage 7 Tech.
- You are not barred from using the Service under the laws of your country of residence.
- You will comply with these Terms and all applicable laws and regulations.
3.2 Account Verification
We may require verification of your identity and age using government-issued identification or other methods. Failure to provide verification when requested may result in account suspension or termination.
4. Account Creation and Security
4.1 Registration
To use certain features of the Service, you must register for an account. You agree to provide accurate, current, and complete information during registration and to keep it updated.
4.2 Account Security
You are responsible for safeguarding your password and other credentials. You agree not to disclose your credentials to any third party and to be responsible for all activities under your account.
4.3 Unauthorized Account Use
Notify us immediately of any breach of security or unauthorized use of your account. We are not liable for losses arising from your failure to comply with these requirements.
5. User Conduct
5.1 Community Guidelines
You agree to use the Service in accordance with our Community Guidelines.
5.2 Prohibited Activities
You agree not to engage in any of the following prohibited activities:
- Impersonating another person or creating an account for someone other than yourself.
- Providing inaccurate information about yourself or your intentions.
- Creating multiple accounts.
- Using the Service for any illegal purpose or to violate any laws.
- Harassing, intimidating, or defaming any User.
- Posting content that is obscene, pornographic, violent, or otherwise offensive.
- Soliciting money or services from Users.
- Promoting commercial activities without our prior written consent.
- Sending spam or unwanted messages to Users.
- Using automated scripts or bots to access the Service.
- Attempting to compromise the security of the Service.
- Infringing upon the intellectual property rights of others.
- Interfering with the proper functioning of the Service.
5.3 User Safety
We maintain a zero-tolerance policy for harmful behavior, including harassment, hate speech, threats, violence, scams, and sexual content involving minors.
6. User Content
6.1 Your Content
You retain ownership rights in your User Content. By submitting User Content, you grant Savage 7 Tech a worldwide, non-exclusive, royalty-free license (with the right to sublicense) to use, reproduce, adapt, publish, transmit, display, and distribute such content.
6.2 Content Restrictions
- You own or have rights to all User Content you share.
- Your User Content will not infringe any third-party rights.
- Your User Content complies with applicable laws.
6.3 Content Monitoring
We may remove or refuse to display any User Content for any reason, including violations of these Terms or Community Guidelines.
7. Subscriptions and Payments
7.1 Subscription Services
Optional subscription-based features are available. By subscribing, you agree to the pricing and billing policies presented at purchase.
7.2 Auto-Renewal
Subscriptions renew automatically unless cancelled at least 24 hours before the period ends. Manage your subscription in account settings.
7.3 Payment Processing
Payments are processed by third-party processors and subject to their terms and privacy policies.
7.4 Refunds
Except where required by law, payments are non-refundable. We may issue refunds at our discretion in exceptional circumstances.
7.5 Price Changes
We may change subscription prices; changes apply to the next billing period after notice.
8. License to Use the Service
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for personal, non-commercial purposes. You may not reverse engineer, copy, or create derivative works of the Service.
9. Privacy and Data Protection
Our Privacy Policy explains how we collect, use, and share personal information. By using the Service, you agree to our data practices.
10. Third-Party Links and Content
The Service may contain links to third-party websites or services. We are not responsible for their content or practices. Your interactions with them are solely between you and the third party.
11. Disclaimers
The Service is provided "as is" and "as available" without warranties of any kind. We do not guarantee uninterrupted or error-free service, or that results will be accurate or reliable.
While we strive to protect our users, we cannot guarantee the identity or intentions of any user. Savage 7 Tech does not conduct criminal background checks on users.
11.3 Personal Decisions and Outcomes
You acknowledge that your interactions, communications, meetings, and decisions made through or in connection with the Service are solely your responsibility. To the fullest extent permitted by law, Savage 7 Tech, its affiliates, and their respective officers, employees, and agents shall not be responsible or liable for any direct, indirect, incidental, consequential, special, exemplary, or other loss, injury, harm, or damages arising out of or relating to relationships or situations that occur on or off the Service. Any support or assistance we may choose to provide is voluntary, at our sole discretion, and does not create any duty of care or continuing obligation.
12. Limitation of Liability
To the maximum extent permitted by law, Savage 7 Tech and its affiliates will not be liable for indirect, incidental, special, consequential, or exemplary damages, including loss of profits, data, or goodwill.
In no event will our total liability to you exceed the amount you paid in the last six (6) months or one hundred dollars ($100), whichever is greater.
13. Indemnification
You agree to defend, indemnify, and hold harmless Savage 7 Tech and its affiliates from any claims or losses arising from your use of the Service, your violation of these Terms, or infringement of third-party rights.
14. Dispute Resolution
Contact us first to try to resolve disputes informally by contacting our support team via email. If unresolved, disputes will be resolved by binding arbitration or small claims court, as permitted by law. You waive class actions.
15. Termination
You may terminate your account at any time. We may suspend or terminate your access immediately for violations of these Terms. Upon termination, your right to use the Service ceases.
16. Changes to Terms
We may modify these Terms at any time. Material changes will be communicated through the Service or via email. Continued use constitutes acceptance of the revised Terms.
17. Miscellaneous
- These Terms constitute the entire agreement between you and Savage 7 Tech.
- If any provision is unenforceable, the remaining provisions remain in effect.
- These Terms are governed by the laws of India, without regard to conflict of law provisions.
- We are not liable for failures caused by circumstances beyond our control (force majeure).
- You may not assign these Terms without our consent; we may assign them as part of a reorganization or sale.
18. Service Availability and Changes
The Service, including any features, content, or functionality, may be added, removed, suspended, or changed at any time without notice. From time to time, the Service may be unavailable (for example, due to maintenance, outages, bugs, or server failures). To the fullest extent permitted by law, Savage 7 Tech and its affiliates shall not be liable for any losses, damages, or claims arising from or related to (i) temporary or prolonged unavailability of the Service; (ii) errors, defects, or delays in features; or (iii) discrepancies between expected features and those actually provided at any given time. We aim to address defects and restore availability promptly, but we do not guarantee any specific response or resolution times and we are not obligated to provide any particular features in the future.
19. Region-Specific Provisions
Residents of the EU/UK, California, and other jurisdictions may have additional rights under local laws such as the EU Consumer Rights Directive and the CCPA/CPRA.
20. Our Intellectual Property
The Service and its original content (excluding User Content), features, and functionality are and will remain the exclusive property of Savage 7 Tech and its licensors and are protected by copyright, trademark, and other laws.
